By requesting an account and access to the “MXT-1 demo” (the “Demonstrator”) made available by Newsbridge SAS (see: https://www.momentslab.com/general/legal), you (“the User”) fully understand and agree to the following terms and conditions (“the Terms and Conditions”). You hereby agree to Moments Lab’s privacy policy terms.
These Terms and Conditions shall apply at all times while Users are browsing the Demonstrator and for as long as the Demonstrator will be made available to the public.
1. Use of Demonstrator: The Demonstrator is provided for the purpose of demonstrating the features and functionality of Moments Lab’s software as a service and the newly developed “MXT-1” service. Users may access the service only for this purpose therefore excluding any production, research or any other purpose.
2. Intellectual Property: The Demonstrator and all related intellectual property are owned by Moments Lab. Users may not copy, modify, distribute, or use any part of the Demonstrator, including but not limited to user interface, names, trademarks and brand names, functions and software code without Moments Lab’s prior written consent.No User may under any circumstances and to the maximum extent possible per applicable law decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Demonstrator and MXT-1 or any services provided by Moments Lab, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of open-sourced components included with the Demonstrator).
3. No Warranties: The Demonstrator is provided "as is", without any warranties, express or implied. Moments Lab does not guarantee the accuracy or completeness of either the Demonstrator or the MXT-1 technology or its suitability for any particular purpose.
4. Limitation of Liability: Moments Lab will not be liable for any direct, indirect, incidental, special, or consequential damages arising of or in connection with the use or inability to use the Demonstrator.
5. Restrictions & abusive use: No User may engage in any of the following uses of the Demonstrator:
a. Automating the creation of demonstration accounts, or requesting more,
b. Modifying code, portions of requests in order to use the Demonstrator for a different purpose than the sole demonstration of the MXT-1 technology,
c. Using the Demonstrator to generate offensive content of any content and more generally any illegal content per international laws and treaties and local laws and regulation,
d. Processing any other media than those provided by Moments Lab in the Demonstrator.
e. Engaging in any behavior counterfeiting the rights of Moments Lab or any other third party, including by reproducing, imitating or reusing protected materials displayed in the Demonstrator.
6. Termination: Moments Lab may suspend or terminate access to the Demonstrator at any time without notice or liability to any User.
7. Governing Law: The use of the Demonstrator and the Terms and Conditions are governed by the laws of France.
8. Privacy: Moments Lab must collect and process personal data in accordance with its privacy policy and applicable privacy laws and regulation in order for the User to access and use the Demonstrator.
9. Changes: The provider may modify these terms and conditions at any time by posting updated terms on the Demonstrator website.
10. Entire Agreement: The Terms and Conditions constitute the entire agreement between the User and Moments Lab and supersede all prior agreements and understandings, whether written or oral.
11. Acceptance: By accessing the Demonstrator, the User agrees to be bound by the Terms and Conditions. If the User does not agree to these terms and conditions, they must immediately discontinue use of the Demonstrator.
12. Credits: Materials and contents reproduced and made available in the Demonstrator are published under their respective license terms by their authors who remain their sole proprietors.
